These Terms of Service ("Terms") govern your use of Nostalgia AI, provided by Limbic Apps Yazılım Ltd. Şti. ("Limbic Apps", "we", "us", "our") via nostalgiaai.app and our iOS/Android apps (together, the "Service"). By creating an account or using the Service, you agree to these Terms.
Nostalgia AI uses artificial intelligence to restore, colorize, sharpen, and animate photos and videos you provide, including turning a still photo into a short video (e.g. making a photo "talk" or blink). Results are AI-generated approximations and are not guaranteed to be historically or factually accurate representations of the people or moments depicted.
You need an account (via Google or Apple sign-in) to use the Service. You're responsible for keeping your account credentials secure and for all activity under your account. You must be at least 13 years old (or the minimum age of digital consent in your country) to create an account.
You keep ownership of the photos and videos you upload ("Input Content") and of the results we generate for you ("Output Content"). By uploading Input Content, you grant us a license to process it (including sending it to our AI processing partners) solely to provide the Service to you. You confirm that you have the right to upload the Input Content and, where it depicts a real person other than yourself, that you have their permission (or are their parent/guardian, or are creating a good-faith tribute/memorial of a deceased loved one) to create an AI-animated or AI-voiced version of their likeness.
You may not use the Service to create content that is illegal, harassing, defamatory, sexually explicit involving minors, or that impersonates a real person in a misleading way intended to deceive (e.g. fabricated statements presented as real). We may remove content or suspend accounts that violate this.
Some features require a paid plan (weekly or yearly) or credits, purchased through our payment processor, Polar. Prices are shown before purchase. Subscriptions renew automatically at the then-current price until cancelled; you can cancel any time from your account settings, and cancellation takes effect at the end of the current billing period. Purchased credits are generally non-refundable once used to generate a result, except where required by law.
You agree not to: use the Service for any unlawful purpose; attempt to reverse-engineer, scrape, or abuse the Service's infrastructure; resell or redistribute the Service without our permission; or use the Service to generate content that infringes someone else's intellectual property or violates their privacy or publicity rights.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE. AI-generated results can be imperfect or occasionally inaccurate — we don't guarantee any particular output quality.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIMBIC APPS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or the Acceptable Use section above.
We may update these Terms from time to time. We'll update the "Last updated" date above when we do; continued use of the Service after a change means you accept the updated Terms.
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles, except where local consumer protection law in your country of residence requires otherwise.
